Extension to Paternity Leave Shelved
Hundreds of employers were considerably relieved when the government put the implementation of new paternity leave arrangements on hold.

The proposal was to permit fathers to take additional paternity leave if the mother of the newly born child returned to work before the end of the maternity leave period to which she was entitled.

Support for the government

Many organisations have significant support for the governments’ decision to ‘can’ the plans, stating that ‘it would be an administrative nightmare for HR and should not be introduced while we are still dealing with the pressures of the recession’. Problematic areas have been highlighted such as the issue that ‘you would have to communicate with the employee’s partner’s employer before the system would be workable’.

Disappointment with the government

Understandably, many employees were bitterly disappointed by the current rejection of the policy, suggesting that the plans would help and encourage mothers to return to the workplace whilst cutting down recruitment pressures for employers who end up with an employee who takes maternity leave and then decides not to return to employment.

Many believe that the recession has nothing to do with the rejection of the bill and claim that employers could cope with the potential costs; others suggest that the government must come up with more effective and workable plans.

The current arrangements
In the meantime employers and staff will have to make do with the current arrangements:

Employees have to satisfy the following conditions in order to qualify for Paternity Leave:-

Have or expect to have responsibility for the child’s upbringing

Be named on the Birth Certificate of the child or be the mother’s husband or partner (including same sex partners)

Have worked continuously for the Company for 26 weeks leading into the 15th week before the baby is due

Eligible employees are entitled to choose to either take one week or two consecutive week’s Paternity Leave. They are paid Statutory Paternity Pay ( SPP) of £123.06 or 90% of their average weekly salary if this is less than £123.06, for the duration of the Paternity Leave. Only one period of paternity leave is available for each pregnancy or adoption, even if more than one child is born as the result of the same pregnancy or if more than one child is placed with an individual or couple for adoption under the same arrangement.
