The importance of procedures

It's not just employers who can fall victim to the detail of procedures. Our article on age discrimination and retirement is a useful reminder of the new rules employers must follow. But they also apply to employees. A tribunal has just ruled that because an employee did not state that their request to work beyond their normal retirement age was being made 'under paragraph 5 of schedule 6 to the Employment Equality (Age) Regulations 2006', it did not comply with the specific requirements of the legislation. This meant that the failings on the employers part were irrelevant (and there were several) and the employee's claim for unfair dismissal claim failed. We kid you not. However, this doesn't mean the next tribunal will be as harsh, so rely on this possible 'get out jail card' at your own risk!
