Can it be fair to dismiss an absent employee if the absence is due to the employer's action?
The answer is yes, but with extra caution. In a recent case an employee was dismissed because of long term absence even though her absence was due to stress caused by bullying at work and the employer's mishandling of her grievance. An employment tribunal said this was unfair as her illness had been caused by her employer's unreasonable behaviour but the Employment Appeal Tribunal overturned this decision. It said that the right test of fairness was if the employer acted reasonably in all the circumstances in dismissing the employee. If the employer had responsibility for an employee's incapacity, the expectation is that it should 'go the extra mile' in trying finding alternative employment for the employee, or to put up with a longer period of absence than would otherwise be reasonable, but it could ultimately effect a fair dismissal.
