TUPE are the regulations designed to preserve employees' terms and conditions when a business or undertaking is transferred to a new employer. The Transfer of Undertakings Protection of Employment Regulations (TUPE) have been around for over 20 years but are still producing uncertainty.
Employees transfer to the new employer with continuity of employment guaranteed at the date of the transfer, including all employment rights and contractual benefits with the exception, at present, of pension rights.
Managing a TUPE transfer successfully is often quite a complex process for both companies involved, the transferor (the one selling the company) and the transferee (the one buying the company).
